{"id":8486,"date":"2019-09-24T05:00:03","date_gmt":"2019-09-24T05:00:03","guid":{"rendered":"http:\/\/rpmonline.co.uk\/?p=8486"},"modified":"2019-09-23T00:51:34","modified_gmt":"2019-09-23T00:51:34","slug":"pledge-music-steps-into-the-shadows-and-leaves-a-lot-of-good-people-in-the-lurch","status":"publish","type":"post","link":"https:\/\/rpmonline.co.uk\/?p=8486","title":{"rendered":"Pledge Music steps into the shadows and leaves a lot of good people in the lurch"},"content":{"rendered":"<p>With their website closed down by the owners\u00a0PledgeMusic reportedly\u00a0froze artists\u2019 funds\u00a0and misspent hundreds of thousands of pounds of musicians\u2019 and fans money to keep the site going for as long as they could before going to the courts to wind up the complany.<\/p>\n<p>In a message clearing the company of any liability over artists\u2019 losses, One executives wrote<\/p>\n<blockquote><p>\u201c<em>To the Artists and Fans of PledgeMusic.<\/em><\/p>\n<p>\u201c<em>As many of you know, PledgeMusic suspended operations a number of months ago.\u00a0\u00a0<strong>The company continues to work with outside counsel on the most appropriate next steps<\/strong>, and we will update you with those specifics as we get more information.<\/em>\u201d<\/p><\/blockquote>\n<p>co-founder Benji Rogers (Rogers founded the company with Jayce Varden in 2009 as a platform in which artists can sell everything from music to personal concerts directly to fans)\u00a0 \u00a0After being widely chastised on social media for breaking his promise to return artists\u2019 money, Rogers wrote,<\/p>\n<blockquote><p>\u201c<em>I went back into [the company] just over three months ago as a volunteer to try and help the board and team turn around and sell the company, but I am sad to report that this effort has not met with success and that\u00a0<strong>PledgeMusic will shortly be heading into administration<\/strong>.<\/em>\u201d<\/p><\/blockquote>\n<p>It appears the company\u2019s changed its mind over the right course of action.\u00a0Instead of heading into administration, Pledge took the sneaky turn of filing a\u00a0petition to\u00a0<a href=\"https:\/\/musictechpolicy.com\/2019\/07\/30\/pledgemusic-winding-up-hearing-july-31-in-london\/\" target=\"_blank\" rel=\"nofollow noopener\">wind up PledgeMusic<\/a>\u00a0in The Gazette.\u00a0 The Execs remained anonymous and Rodgers left the company in 2016 and started his current company\u00a0CSO to Dot Blockchain Media.<\/p>\n<p>Pledge&#8217;s\u00a0 CEO and another executive who chose to remain anonymous attributed many of the problems to an unexpected change in the company\u2019s payment fulfillment system, restated their commitment to the company and its crowdfunding model, and insisted the company was \u201cworking through\u201d the problems. That was almost a year ago. t CEO, Dominic Pandiscia, stepped down, but the company reshuffled its senior management and pointed to new investors.<\/p>\n<p><a href=\"http:\/\/rpmonline.co.uk\/wp-content\/uploads\/2019\/09\/download-3-1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-8491 alignleft\" src=\"http:\/\/rpmonline.co.uk\/wp-content\/uploads\/2019\/09\/download-3-1.jpg\" alt=\"\" width=\"318\" height=\"159\" srcset=\"https:\/\/rpmonline.co.uk\/wp-content\/uploads\/2019\/09\/download-3-1.jpg 318w, https:\/\/rpmonline.co.uk\/wp-content\/uploads\/2019\/09\/download-3-1-300x150.jpg 300w\" sizes=\"auto, (max-width: 318px) 100vw, 318px\" \/><\/a>If they&#8217;d headed into administration, it would have allowed musicians, fans, and vendors the opportunity to officially speak out against the company\u2019s behavior, PledgeMusic has simply closed the platform through the High Courts. therefore kinda just walking away.<\/p>\n<p>The RCOJ granted Pledge their winding-up order and appointed an Official Receiver (OR), who will liquidate all of the company\u2019s assets. The official Receiver has commented via <a href=\"https:\/\/twitter.com\/insolvencygovuk\/status\/1157242488182181888\" target=\"_blank\" rel=\"noopener\">tweets\u00a0<\/a>\u00a0I guess a clearer picture will be made as to what course of action they will take but maybe parties affected should follow their twitter account to keep up to date with the state of play.\u00a0 Sadly I guess the artists will go to the back of the queue behind the government (or HMRC) who always get paid in full and the fans will go behind the bands in the pecking order.\u00a0 Most will have already written off their product as a bad job after artists gave their own updates to their individual predicaments. I wouldn&#8217;t have thought the company had many assets that can be sold on due to the platform it ran but I guess seeing the Execs being prosecuted would be a just desert and the guilty parties being brought to book, but its scant consolation to the all the bands, studios, labels, musicians and fans who are left out of pocket.<\/p>\n<h4><\/h4>\n<p>Not everybody will get involved no doubt but some have spoken up on behalf of artists such as\u00a0<a href=\"https:\/\/www.musicweek.com\/digital\/read\/uk-music-calls-for-government-action-as-pledgemusic-goes-to-court-for-winding-up\/076962\" target=\"_blank\" rel=\"nofollow noopener\">UK Music<\/a>\u00a0who spoke out about the order.\u00a0 In a letter to Business Minister Kelly Tolhurst, Deputy CEO Tom Kiehl urged the government to step in.<\/p>\n<blockquote><p>\u201c<em>Many musicians across the UK relied on crowdfunding website PledgeMusic to deliver payments from patrons, to pay for album recordings, and other costs. \u00a0The winding up of this company represents an entirely unsatisfactory development for the many music fans and creators who have invested so much into projects through this scheme.<\/em><\/p>\n<p>\u201c<em>I ask you to again consider the merits of a ministerial referral to the Competition and Markets Authority to investigate what went wrong with this case.<\/em><\/p>\n<p>\u201c<em>I would also like to ask you to consider taking up the case with the Financial Conduct Authority, which holds responsibility for regulating certain types of crowdfunding, to consider the activities of PledgeMusic and whether there have been any regulatory breaches<\/em>.<\/p>\n<p>\u201c<em>Furthermore, I would like to ask for a meeting with you to consider further possible Government interventions to ensure the issues which have arisen from PledgeMusic can never happen again.<\/em>\u201d<\/p><\/blockquote>\n<h4><\/h4>\n<p>One band\u00a0<a href=\"https:\/\/www.facebook.com\/L7theband\/\" target=\"_blank\" rel=\"nofollow noopener\">L7<\/a>\u00a0vowed to take the former company\u2019s executives to court.\u00a0 Calling the crowdfunding platform a fraudulent scheme, the band wrote,<\/p>\n<blockquote><p>\u201c<em>To give a brief summary for those not familiar with the Pledge Music scam, in a nutshell, the funds that many bands and their supporters raised through the crowdfunding platform were absconded by the company with zero accountability and unreturned legal appeals. \u00a0Their site is no longer live and they are filing for bankruptcy protection in the U.K.<\/em><\/p>\n<p>\u201c<em>It\u2019s been a disappointing, time consuming, and expensive mess for all artists and fans involved with this Pledge Music FIASCO.<\/em>\u201d<\/p><\/blockquote>\n<p>they also commented,<\/p>\n<p>\u201c<em>We do not wish to further comment on this situation as we do not want to be the face of being screwed over. \u00a0L7 are bigger and mightier than this mess. \u00a0The only time we will speak of this again will be in a courtroom.<\/em>\u201d<\/p>\n<p>&nbsp;<\/p>\n<p>This might play out for some considerable time yet but once they do get to the bottom of just what went on we&#8217;ll hopefully have some news to give both fans and artists.\u00a0 Don&#8217;t hold your breath though it might be some time.
